1. Acceptance of Terms

By accessing or using SitePulso ("the Service"), operated by SitePulso ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

SitePulso provides website, server, and API uptime monitoring services. The Service includes monitoring checks, alert notifications, status pages, and related reporting tools. Features and limits vary by subscription plan.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the Service to monitor URLs or servers you do not own or have authorization to monitor
  • Use the Service to conduct denial-of-service attacks or load testing
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without written permission
  • Use the Service in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Transmit viruses, malware, or any harmful code through the Service

5. Subscription and Billing

5.1 Free Plan

The Free plan provides limited access to the Service at no cost. We reserve the right to modify Free plan features and limits at any time.

5.2 Paid Plans

Paid plans are billed monthly or annually in advance. Prices are in US Dollars (USD). We may change pricing with 30 days advance notice. Price changes do not apply to the current billing period.

5.3 Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation, your access continues until the end of the current billing period. We do not offer prorated refunds for partial billing periods.

6. Service Level Agreement

We commit to a 99.9% uptime SLA for the monitoring platform itself. If we fail to meet this SLA in any calendar month, affected paid customers may request a service credit equal to 10% of their monthly fee for each full 0.1% below the 99.9% target, up to a maximum credit of 100% of the monthly fee.

7. Data Ownership

You retain ownership of all data you submit to the Service, including monitor configurations and check results. We claim no ownership over your data. Upon account termination, you may request a data export within 30 days.

8. Intellectual Property

The Service, including its design, code, logos, trademarks, and documentation, is the intellectual property of SitePulso. These Terms do not grant you any right to use our trademarks, logos, or brand assets without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, SitePulso shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you to SitePulso in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, or that all downtime incidents will be detected and reported.

11. Indemnification

You agree to indemnify and hold harmless SitePulso and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive (including Limitation of Liability, Indemnification, and Governing Law).

13. Modifications to Terms

We may modify these Terms at any time by posting updated Terms on this page. Material changes will be communicated via email or a notice within the Service. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules.
